These Terms and Conditions govern the contracting of services with Agencia Mejor Digital (THINKITGLOBAL SRL) (hereinafter, “the Agency”).
1. Acceptance of Terms
Payment of any invoice issued by the Agency constitutes the client’s express, full, irrevocable and unconditional acceptance of these Terms and Conditions, which are permanently published and available on our website.
2. Commercial and Administrative Conditions
2.1. Currency and Taxes: Unless explicitly stated otherwise, all prices are expressed in Argentine Pesos (ARS). The amounts indicated are net and do not include Value Added Tax (VAT), withholdings, or any other applicable taxes or fees, which will be added to the invoice accordingly.
2.2. Validity of Proposals: Commercial proposals and quotations are valid for fifteen (15) calendar days from the date of issuance. After this period, conditions and prices may be unilaterally modified by the Agency.
2.3. Agency Credit: All work is delivered by default with Agency credit (logo and/or website link). The client may request removal of such credit, which will entail an additional cost of no less than thirty percent (30%) of the total project value.
2.4. Portfolio Inclusion: The Agency reserves the right to include work carried out for the client in its institutional portfolio (website, social media, and other media), always respecting the confidentiality of sensitive information.
2.5. Services and Costs Not Included: Unless explicitly stated in the proposal, the following are not included in fees:
- Hosting, housing, or domain registration.
- Logo vectorization or redrawing of graphic material.
- Translation services.
- Photography and/or video production or contracting.
- Purchase of licenses for images, fonts, plugins, or any third-party assets.
- Bulk content or product uploads.
3. Service Modalities
3.1. Monthly Hour Plans:
- Preferential Rate: Monthly plans include a 30% discount compared to On-Demand services.
- Hour Accumulation: Unused hours carry over automatically to the following month and are added to the new allocation.
- Conversion to On-Demand: In case of plan cancellation, accumulated hours can be converted to On-Demand hours by paying an administrative fee of 30% of the current hourly package rate.
3.2. Web Development:
- With Agency Hosting: Hosting services include initial setup, file upload, and website launch at no additional cost.
- With External Hosting: If the client uses external hosting, the Agency’s responsibility is limited to delivering the project files; support or configuration for third-party services is excluded.
4. Estimated Delivery Times
Delivery times are estimated, expressed in business days, and start from the date the client provides all required materials (texts, images, access credentials, etc.). Client review or feedback times are not included.

5. Contracting and Cancellation
5.1. Initial Consultation: Fees paid for the first consultation meeting will be credited as a service credit if used within seven (7) days. Subsequent consultations are non-refundable.
5.2. Monthly Service Cancellation: Cancellation requires written notice (email) at least twenty (20) business days before the next renewal date. Otherwise, the service will automatically renew for a new period.
5.3. Project Interruption and Refund Policy:
- No refunds will be given if services cannot be executed due to circumstances beyond the Agency’s control (lack of material delivery, external domain or hosting issues, unilateral client cancellation, internal client disputes, etc.).
- Expenses and hours incurred will be charged; any remaining balance will be credited for future services with the Agency.
6. Intellectual Property
All intellectual property rights over designs, developments, code, graphics, and other materials remain with the Agency until full payment. Once paid, patrimonial rights over the final product are transferred to the client, except for third-party materials subject to license agreements.
7. Confidentiality
Both parties agree to maintain strict confidentiality regarding all technical, commercial, or strategic information accessed during the contractual relationship and will not disclose it to third parties without written authorization.
8. Limitation of Liability
The Agency shall not be liable for indirect damages, lost profits, data loss, or business interruptions. The maximum liability of the Agency shall not exceed the amount actually paid by the client for the service giving rise to the dispute.
9. Force Majeure
The Agency shall not be responsible for non-performance or delays caused by force majeure or acts beyond its reasonable control, including (but not limited to) internet outages, power cuts, government actions, labor disputes, pandemics, or other unforeseen events.
10. Jurisdiction and Applicable Law
Any dispute arising from the interpretation, validity, or enforcement of these Terms and Conditions shall be submitted exclusively to the Ordinary Courts of the Autonomous City of Buenos Aires, Argentina, expressly waiving any other jurisdiction that may apply.
